What is H4 Visa and H4 EAD?

H4 Visa is a dependent visa (family members) on the H1B visa holder. H4 visa is issued by the USCIS to the spouse and children (below the age of 21 years) of H1B visa holder in order to legally allow them to arrive and stay in the USA.

The spouse of H1B can apply for Employment Authorization Document later to the USCIS and are also allotted with SSN numbers. H4 EAD allows working in the United States if they fit in certain terms and condition on H4 EAD.

Conditions to get H4 EAD:

Having approval on the Immigration petition I-140
Under the AC21 Act should have H1B visa status extended (spouse beyond Six years in condition if their permanent residency or green card application is pending).

Process of H4 Visa Application

Process of application in 4 steps:

STEP 1: Fill with form I-765

Download the form I-765 from the USCIS website.
Fill the form as per the Instructions stated on the website.
Select options as per the reason of application whether for new application of H4 EAD/ renewal / in case if lost the card.
Use black pen only to fill the signature column.
Submit the form the form.

STEP 2: Attach the form along with necessary documents

Once after completing the form attach along with the necessary documents as listed:

Application fee for H4 EAD.
A separate copy of form I-94.
A separate copy of your previous EAD.

In case if never got an EAD before:

National ID document
Copy of Issued visa by foreign consulate.
Birth Certificate.
A copy of Passport.

Two photos. (mention your I-94 form number with pencil on the back of both photos)

Complete with the form G-1145 for getting E-notifications on your mails and text messages and attach it on the first page of your application.

As a proof of your legal status attach either form I-94 or I-797.

For the verification of relationship status attach a copy of marriage certificate.

Attach with approved form I-140 along with a copy of form I-797.

H1B visa approval notices of H1B spouse’s along with passports and previous copy of form I-94 and current as well as previous form of I-797 for the procedure of petition for I-129.

You can also attach with a print out of DOL’s (Department of Labour’s) website and a copy with H1B spouse’s ITIN number (Individual Taxpayer Identification Number)

Attach the following documentation:
1. Attach your cheque on the Top of the application.
2. Attach with the form G-1145 under the money order or cheque.
3. Attach with the form G-28 (If filing is done by your attorney).
4. Attach with signed and filled form I-765.
5. Other documentation.

NOTE: USCIS prefer documents attached using paper clips instead of staples.

STEP 4: Collect Receipt

After completing with the process of sending the documents to the USCIS, you will receive a notice receipt and then the procedure for your application will be started. The duration for the procedure varies from location to location in respect to where it was filled.

Once the procedure is done by the USCIS they will sent you with the approved H4 EAD card. The card would be listed under the category of C26.
